Inclusika is committed to keeping your Personal Information private. We only share Personal Information to third parties in order to provide Services to you, if you consent to it, in the circumstances outlined in this policy or as required by law.

Your use of our Websites and Services will be deemed to be confirmation that you have had sufficient opportunity to access this Privacy Policy and that you have read it and that you agree to it.

1. INTERPRETATION AND DEFINITIONS

References to the words us, we, our throughout this Policy are references to Inclusika, an Australian registered business with the ABN 14 693 957 689.

References to the words you or your throughout this Policy are references to any person using our Websites or our Services.

 

Health Information has the meaning given in section 6FA of the Privacy Act 1988 (Cth).

 

Personal information has the meaning given in section 6 of the Privacy Act 1988 (Cth).

 

Privacy Law means the Privacy Act 1988 (Cth), Health Records and Information Privacy Act 2002 (NSW) and Health Records Act 2001 (Vic).

 

Sensitive Information has the meaning given in section 6 of the Privacy Act 1988 (Cth).Services means the Services that Inclusika provides including connecting people to health and Wellbeing providers.

 

2. SCOPE OF THIS POLICY

This Privacy Policy sets out our commitment to protecting Personal Information that we collect about you through your use of our Websites, www.inclusika.com.au; www.inclusika.au and www.inclusika.com (“our Websites”).

 

We may change the terms of this Privacy Policy at any time, but will comply with Privacy Laws.

3. USING OUR WEBSITE AND SERVICES

You do not have to provide us with any Personal Information. We note if you do not provide us with Personal Information, it may affect the Services we provide to you or prevent us from providing Services to you.

We use Personal Information for the purpose for which it was collected, for related purposes that would be expected or as outlined in this Policy. You have the option of interacting with us anonymously or by using a pseudonym, except where it is impractical for us to provide services to you without knowing your real or legal name or where the law requires us to collect your real or legal name. In some cases, we will not be able to provide you with Services if we do not know your legal name.

4. INFORMATION WE COLLECT AND HOLD

 

4.1 Health Information and Sensitive Information

Inclusika’s aim is to help groups in our community with diverse needs to access health and Wellbeing support that is inclusive, high quality and safe. We understand that when accessing our Services, you might share your Health Information or Sensitive Information with us. If you do this, please be aware that we may collect and hold Personal Information about you to provide Services to you or for any other reason specified in this Policy. The information we collect will depend on what you share with us, but could include for example, your name, whether you are neurodivergent or not, your gender identity, your cultural or ethnic background etc.

We collect, use, store, share and dispose information only in accordance with this Policy.

 

4.2 Service improvements

We may collect and hold Personal Information for the purpose of improving our Services.

 

4.3 Newsletter/mailing list subscriptions

If you subscribe to our electronic newsletter, we may collect and hold Personal Information such as your name and email address in order to provide you with updates on our Services, tips, insights or stories on inclusive care.

Your subscription to our newsletter will be deemed as acceptance of the manner in which Mailchimp and Wix manage your Personal Information according to these policies.

 

4.4 Providing feedback to us, sending emails etc

If you send us emails or respond to any questions raised in our newsletters, we may collect and hold Personal Information such as your name and email address and any other Personal Information you share with us so we can communicate with you.

 

4.5 Engaging with us on social media platforms

We may collect Personal Information from you if you engage with us on any our official social media accounts (including but not limited to making public comments or posting images on our feed, liking our content, following us, sending us direct messages, tagging us or sharing our content). The type of information we collect could include your social media handle, name, location and any other Personal Information that appears in the content you share with us. We collect this information so we can interact with you.

 

4.6 Embedded content from other websites

Articles on our Websites may include embedded content (eg videos, images, articles, etc). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website. You agree to check the privacy policy of any third party websites or embedded content before using them and that your use of our website means you agree to those third party’s use of your Personal Information.

Our Websites may use cookies to monitor browsing preferences for creating anonymous usage statistics, website analytics, user experiences improvements, personalisation, advertising or storing Personal Information that you provide to us via a form on our Websites.

Some cookie information may be shared with third parties such as Wix or MailChimp for the purposes of providing our newsletter to you or Meta or Google for advertising or analytics purposes.

We may use Meta for Business and Meta Pixel, Google Analytics, or other analytics tools, to understand how people use our Websites or our Services.

We may engage in advertising including on social media platforms such as Facebook and Instagram or Google. If you engage with our online advertisements on these external platforms, we may collect Personal Information about you that is provided to us by such platforms.  

 

5. DISCLOSURE TO THIRD PARTIES

We will not give your Personal Information to any third party except:

  1. to provide Services to you;

  2. if you have consented to the disclosure;

  3. in the limited circumstances specified in this Privacy Policy; or

  4. if the law requires us to disclose.

 

To provide our Services, including engaging in advertising as set out above, it is possible that we will disclose information to overseas recipients to Wix in Luxembourg and to companies in the United States such as Meta, Google or Mailchimp.

6. STORAGE AND DISPOSAL OF PERSONAL INFORMATION

We take all reasonable steps to store Personal Information securely.

We will also dispose of Personal Information securely. This includes de-identifying data and destroying or deleting it using secure disposal methods.

7. RIGHTS YOU HAVE OVER YOUR PERSONAL INFORMATION

You can request to access and receive a file of the Personal Information we hold about you. If you believe any of the Personal Information is incorrect, you may request that we correct it and we will do so.

You can also request that we erase any Personal Information we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. You understand that if you ask us to erase Personal Information held about you, we may not be able to continue to provide Services to you.

​We note that we do not have control over the privacy practices of individual health and wellbeing providers. Any questions or issues about individual providers’ privacy practices need to be directed to the specific provider.

 

9. COMPLAINTS

We cannot deal with complaints about individual health and Wellbeing providers as those complaints need to be directed to the individual provider.

However, if you believe Inclusika has breached any of the privacy rights, you may make a complaint by contacting us as per the 'contact us' section above. Please put ‘Privacy’ in the subject line. We will manage your complaint by:

  • being prompt, fair and honest in our dealings with you;

  • considering whether Privacy Laws apply in relation to the complaint and notify you if they don’t;

  • investigating the issue thoroughly if Privacy Laws apply;

  • working with you to resolve the issue.

 

If you are unhappy with our attempts to resolve the situation, you may make a complaint to the Office of the Australian Information Commissioner. Alternatively, if the issue is related to:

  • health records in NSW - you may make a complaint to the Information and Privacy Commission NSW; or

  • health records in Victoria – you may make a complaint to the Victorian Health Complaints Commissioner.
